These Terms of Service ("Terms") govern your use of https://sergiosfriends.com (the "Site") and any purchase you make from Sergios Friends LLC, operating as Sergiosfriends ("we," "us" or "our"). Please read them carefully before using the Site or placing an order.

1. Acceptance and eligibility

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. You must be at least 18 years old, or the age of majority in your state of residence, and have the legal capacity to enter into a binding agreement. You agree to use the Site only for lawful purposes.

2. Products, pricing and payment

All products are subject to availability and may be changed or discontinued at any time without notice.
Product images are for illustration. Actual colors and sizes may vary slightly depending on your screen and on normal manufacturing variation.
Prices are listed in US dollars (USD). Applicable sales tax is collected where required by law and shown at checkout.
Payment must be authorized before an order is processed.
We make every effort to display accurate information, but errors can occur. We reserve the right to correct pricing, typographical or listing errors at any time and to cancel and refund any order affected by such an error.

3. Orders

Submitting an order is an offer to purchase and does not by itself mean that we have accepted it. We may refuse or cancel any order, including for reasons such as limited inventory, payment failure, suspected fraud, pricing or listing errors, or shipping restrictions. If we cancel your order, we will notify you and refund any payment to the original payment method.

You may request to cancel your order by emailing support@sergiosfriends.com within 1 hour of placing it. Approved cancellations are refunded to the original payment method.

4. Shipping and returns

We ship only to addresses within the United States. Delivery dates are estimates and are not guaranteed; delays may occur because of weather, carrier issues, holidays or other causes beyond our reasonable control. Returns and refunds are governed by our Return & Refund Policy, and shipping details are described in our Shipping Policy.

5. Intellectual property

All content on the Site, including text, graphics, logos, photographs, product designs and software, is owned by or licensed to Sergios Friends LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify or use any content without our prior written permission.

6. Acceptable use

You agree not to:

Use the Site for any unlawful or fraudulent purpose;
Attempt to gain unauthorized access to the Site, its servers or any related systems;
Introduce viruses, malware or other harmful code;
Interfere with or disrupt the operation or security of the Site;
Scrape, harvest or collect data from the Site by automated means without our permission; or
Infringe the intellectual property or other rights of any person.

7. Disclaimers, limitation of liability and indemnification

The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.

To the fullest extent permitted by law, Sergios Friends LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or any product purchased through it. Our total liability for any claim relating to an order shall not exceed the amount you paid for that order.

You agree to indemnify and hold harmless Sergios Friends LLC and its owners, officers, employees, affiliates and service providers from any claims, losses or expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.

8. Governing law, disputes and changes

These Terms are governed by the laws of the United States and of the State of Florida, without regard to conflict-of-law principles. If a dispute arises, please contact us first so we can try to resolve it informally. If we cannot resolve it within a reasonable time, the dispute shall be resolved by binding arbitration where permitted by law, except that either party may bring an individual claim in small-claims court.

We may update these Terms from time to time. Changes take effect when posted on this page with a new "Last Updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.

9. United States sales only

Sergiosfriends sells and ships products only within the United States. We do not accept orders for delivery outside the US, and these Terms apply to customers in the United States.
